EXECUTIVE DIRECTIVES TO IMPROVE IMMIGRANT AND NONIMMIGRANT PROGRAMS FOR ENTREPRENEURS, INVENTORS AND OTHERS

As part of President Obama’s executive initiatives on immigration, the administration has outlined a plan to better attract skilled workers and entrepreneurs while reducing burdensome immigration pitfalls on U.S. employers. According to the Department of Homeland Security (DHS), it will be making regulatory changes to allow high skilled workers awaiting legal permanent residency (and their spouses) to change jobs more easily. DHS is also finalizing new rules that will give employment authorization to H-4 visa holders (spouses of H-1B visa holders) who have approved applications for permanent residency. The United States Citizenship and Immigration Service (USCIS) has also stated plans to clarify both adjustment portability and the standard for granting a national interest waiver to foreign inventors, researchers and founders of start-up enterprises with the goal of benefiting the U.S economy and increasing job mobility.
