USCIS Continues Processing of DACA Renewals In Light of Recent Injunction

A federal judge has issued a permanent injunction against the DACA program and ordered that new and pending initial DACA applications may no longer be processed by the Department of Homeland Security. The judge determined that, in establishing the program, the Obama Administration had exceeded its authority and did not follow procedural requirements. The Biden Administration is expected to appeal the court’s decision. Several bills to provide permanent relief for Dreamers are currently pending in Congress.
USCIS has confirmed that the agency will continue to process renewal applications and employment authorization requests submitted by current DACA grantees. For now, existing beneficiaries will retain their current deportation relief and employment authorizations. Although DACA cannot grant new initial DACA applications, the agency will continue to accept them.
