USCIS ADVISES L-2 SPOUSES TO WAIT FOR EAD CARD BEFORE STARTING WORK

In a recent Q & A session, United States Citizenship and Immigration Services(USCIS) clarified that it will continue to follow a policy requiring L-2 spouses to apply and receive an employment authorization document (EAD) before starting work. USCIS explained that an I-94 number is not a sufficient document for I-9 purposes. This policy is potentially at odds with a recent legal decision which held that current regulations do not require E-2 spouses to obtain an EAD to engage in employment.
