The Department of Homeland Security has made an announcement that the randomized H-1B Visa lottery selection process is being replaced “with a weighted selection process” that favors “higher-skilled and higher-paid” foreign workers. The changes are set to become effective for the FY 2027 registration period. The Trump administration has been critical of the random selection process citing abuse by the employers. Earlier in the year, the administration issued the Presidential Proclamation requiring “employers to pay additional $100,000 per visa as a condition of eligibility” for foreign workers outside the U.S. without a valid H-1B or for those inside the U.S. requesting consular/port-of-entry processing.
