18 Month TPS Extension for Honduras and Nicaragua Announced

On October 16, 2014, the Department of Homeland Security (DHS) announced an 18 month extension of the Temporary Protected Status (TPS) designation for eligible Honduran and Nicaraguan nationals from January 6, 2015 through July 5, 2016. Current TPS holders must re-register during the 60-day re-registration period that runs from October 16, 2014, through December 15, 2014. In addition, employment authorization documents (EADs) for Honduran and Nicaraguan TPS beneficiaries bearing an extension date of January 5, 2015 are automatically extended for a 6-month period (through July 5, 2015). Employers should accept the EADs and a copy of the Federal Register notice showing the TPS extension for Honduras and Nicaragua as valid "List A" documents. Employers should not request proof of Honduran or Nicaraguan citizenship or ask for additional Form I-9 documentation if a worker presents an EAD that has been automatically extended. After July 5, 2015, employees may present a new EAD bearing an expiration date of July 5, 2016, and employers should no longer accept an EAD with an earlier expiration date.
