H-1B Professional Visas
The H1-B visa classification authorizes foreign nationals to work for a temporary period in specialty occupations that require theoretical or technical expertise. Examples of occupations include positions in architecture, engineering, mathematics, physical sciences, social sciences, biotechnology, medicine and health, education, law, accounting, business specialties, and theology, among others. The prospective employee must have earned at least a bachelor's degree or equivalent.
The visa duration is issued in three year increments and is extendable to six years. Certain exceptions to the maximum length of stay may apply in limited circumstances. H1-B visas are subject to yearly numerical limitations of 85,000 per year (with 20,000 reserved for employees with a master's degree or higher from U.S. colleges or universities).
The application process for the H1-B requires that an employer submit both a petition for an employee and an approved labor condition application (LCA).
